Luxury Leisure wins appeal to open new Whitby AGC after inspector finds ‘no compelling evidence’ regarding noise and disturbance objections

Luxury Leisure has been granted permission to open a new 24-hour Admiral AGC in Whitby after Government planning inspectors approved the proposal on appeal.

North Yorkshire Council had rejected the proposal in March 2025, after receiving 500 objections, however plans for the former bank unit on Baxtergate can now progress.

“The inspector said he found ‘no compelling evidence’ that the proposal would lead to noise levels that would adversely affect or disturb the living conditions of the residents in nearby properties,” reported the York Press.

“​The inspector said he took into consideration ‘the weight of public opposition to the proposal’ but his decision was based on its acceptability based on planning policy.”

Following approval, Luxury Leisure has now applied for permission to renovate the exterior of the property, installing “halo illuminated individually located lettering that is appropriate for a 24-hour use, and a slimline externally illuminated hanging sign above the fascia.”

“The proposed shopfront and signage compare favourably with the previously approved Halifax arrangement of aluminium fascia and externally illuminated hanging sign with illuminated ATM and obscure vinyl.”

According to Scarborough News, North Yorkshire Council has not yet set a date for deciding on the signage proposal, which is currently open to representations.
